Welcome to Beckford Apex Logistics LLC ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website located at beckfordapexlogisticsllc.com (the "Site") and our courier, delivery, and logistics services (the "Services").

By requesting a quote, booking a delivery, or using our Site, you agree to be bound by these Terms. If you do not agree, please do not use our Services or Site.

  1. Description of Services

Beckford Apex Logistics LLC provides regional courier, scheduled route, weekend, evening, and hot-shot delivery services. We specialize in medical specimens, legal documents, small parcels, and freight transport within Barnstable County and surrounding regions.

  1. User Obligations & Cargo Restrictions

You represent and warrant that you are the owner or authorized agent of the owner of any goods tendered for transport. You agree that you will not request transport for any goods that are:

  • Hazardous materials, explosives, or combustible liquids.
  • Illegal under federal, state, or local laws.
  • Live animals or perishable items requiring specialized refrigeration are not agreed upon before dispatch.
  1. Scheduling, Cancellations, & Delivery Attempts
  • Bookings: All requests for pickup and delivery must be confirmed via our digital booking system or customer dispatch line.
  • Cancellations: Cancellations made within 2 hours of the scheduled pickup time may incur a late cancellation fee.
  • Unsuccessful Delivery: If a delivery cannot be completed due to the recipient being unavailable or the delivery address being incorrect, we will contact you for instructions. A secondary delivery fee may apply for subsequent attempts or return-to-sender actions.
  1. Payment Terms & Invoicing
  • Rates: Service rates are based on mileage, urgency, weight, dimensions, and operational hours (including evening and weekend premiums).
  • Payment: Payments are due upon receipt of the invoice or at the time of booking unless a corporate net-payment account has been established in writing.
  • Late Payments: Past due balances are subject to a finance charge of 5% per month.
  1. Limitation of Liability & Cargo Claims
  • Maximum Liability: Our liability for any loss, damage, or destruction of cargo during transport is strictly limited to $100.00 per shipment, unless the sender declares a higher value and pays an additional valuation fee before pickup.
  • Excluded Losses: We are not liable for any indirect, incidental, or consequential damages, including loss of income, profits, or business opportunities, resulting from delayed or missed deliveries.
  • Force Majeure: We are not liable for delivery failures or delays caused by events beyond our control, including extreme weather conditions, traffic accidents, construction, road closures, or acts of God.
  1. Filing a Claim

Any claims for damaged, lost, or delayed shipments must be submitted in writing within 7 days of the scheduled delivery date. Claims must include documentation of the items' value and physical evidence of damage.

  1. Governing Law

These Terms and any disputes arising out of our Services shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law principles.

  1. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will take effect immediately upon being posted to the Site. Your continued use of our Services after modifications are published constitutes acceptance of the updated Terms.
